Terms of Service

The service. ProbateCheck is a managed search and retrieval service for England & Wales probate records. For a £29 fee we search the official records, place the order for the grant of probate and will (or lodge a standing search where no grant exists), and deliver the documents with a plain-English explanation.

The official alternative. You can order the same probate records yourself directly from GOV.UK for £16 (gov.uk/search-will-probate), or lodge a standing search for £4. Our £29 fee is a service charge that includes those government fees plus searching, ordering, monitoring and explanation. We are independent and not affiliated with HMCTS or GOV.UK.

Scope. We cover England & Wales. Scotland (Confirmation) and Northern Ireland use separate systems we do not currently search. We are not a law firm and do not provide legal advice.

Results. Where probate has been granted, the record is public and we will obtain it. Where no grant exists, no public record exists to retrieve; in that case we lodge a 6-month standing search so documents reach you automatically if a grant is later issued. An absence of records is a valid result, and we will explain what it usually means.

Refunds. If we cannot start your search, we refund in full. If you gave incorrect details, contact us and we will re-run the correct search once at no charge.

Liability. Our total liability for any order is limited to the fee paid for that order. Nothing excludes liability that cannot lawfully be excluded.
